It is the importer’s responsibility to identify and to ensure it has complied with, all requirements of any other regulatory and advisory bodies prior to and after importation including the Australian Customs Service, Therapeutic Goods Administration, Department of Health and Ageing, Department of the Environment, Water, Heritage and the Arts, Australian Pesticides & Veterinary Medicines Authority and any State agencies such as Departments of Agriculture and Health and Environmental Protection authorities. Importers should note that this list is not exhaustive. Importers should also note that all foods imported into Australia must comply with the provisions of the Imported Food Control Act 1992 , an Act which is administered by AQIS. Notification of the import must be provided to AQIS for all imported goods other than goods imported as accompanied baggage or goods imported via the mail and not prescribed under the Customs Act 1901. Notification must be consistent with Quarantine Regulations 2000 (examples include a Quarantine Entry or a Quarantine declaration). |

Imported hybrids must be clearly labelled with their full parentage for identification by AQIS. Importer’s Responsibilities 1. An Import Permit is not required. 2. Genetically modified seeds must be accompanied by
a copy of a valid Import Permit. All applications must be forwarded to AQIS
Plant Programs, 3. It is the importer’s responsibility to check state government/local government requirements to ensure that the seed is permitted entry into that state/territory. 4. For commerical consignments of seed, the importer must contact the AQIS regional office in the port of entry to confirm all arrangements for inspections and treatments. 5. The importer is responsible for payment of all associated AQIS fees and charges. 6. Seed must be free of live insects, soil, disease symptoms, prohibited seeds, other plant material (e.g. leaf, stem material, fruit pulp, pod material, etc.), animal material (e.g. animal faeces, feathers, etc.) and any other extraneous contamination of quarantine concern. 7. All consignments imported into 8. Each shipment must be packed in clean, new packaging, clearly labelled with the full botanical name (i.e. genus and species). 9. Packets of seed containing mixed genera or species are
not permitted entry due to the difficulties of inspecting them for
contaminants. Importers wishing to import packets of seed containing mixed
genera or species must obtain prior approval from AQIS. All applications must
be forwarded to AQIS Plant Programs, Note: Where the Quarantine Officer is able to determine that the packet of seed consists of blends or mixes of traits (such as colour or size) of the same species then the seed may be permitted entry provided that all other conditions of import are met. 10. Pelleted seed of permissible flower, vegetable, herb and pasture/forage seeds may be permitted entry provided that the pelleted seed was commercially produced and packaged and pelleting was carried out using inert material only, see Pelleted Seed Conditions below for further details on requirements and conditions of entry. 11. Containers, timber packing, pallets or dunnage associated with the consignment will be subject to inspection and treatment on arrival, unless certified as having been treated by an AQIS approved treatment. (Refer to the AQIS publication ‘Cargo Containers: Quarantine aspects and procedures’). 12. Full Container Load (FCL) Consignments In addition to the above, the following requirements also apply to FCL consignments: a) Consignments from non-khapra beetle countries: Containers: open-top, open-sided and insulated require: · a packer’s declaration stating: "The container(s) covered by this document has/have been cleaned and is/are free from material of amimal and/or plant origin and soil" and · an official international Phytosanitary certificate for the agricultural produce immediately prior to loading. b) Consignments from khapra beetle countries: Containers: open-top, open-sided and insulated require: · a packer’s declaration stating: "The container(s) covered by this document has/have been cleaned and is/are free from material of amimal and/or plant origin and soil" and · an official international Phytosanitary certificate for the agricultural produce immediately prior to loading with the added endorsements stating it was free from khapra beetle (Trogoderma granarium Everts). c) Timber packaging, pallets, or dunnage in FCL consignments will be subject to inspection and treatment on arrival, unless certified as having been treated by an AQIS approved treatment. (Refer to the AQIS publication ‘Cargo Containers: Quarantine aspects and procedures’). 13. All documentation must be presented to a Quarantine Officer for examination on arrival. 14. All consignments must be inspected on arrival and samples drawn to inspect for freedom from live insects, soil, disease symptoms, prohibited seeds, other plant material (e.g. leaf, stem material, fruit pulp, pod material, etc.), animal material (e.g. animal faeces, feathers, etc.) and any other extraneous contamination of quarantine concern. 15. Consignments may require ISTA sampling and analysis. It is not possible to provide comprehensive instructions that will cover every situation that may arise in dealing with the quarantine inspection and sampling of consignments of seeds, but the following may be used by the Quarantine Officer as a general guide: a) Individual lines or lots of seed with a combined weight of 10 kgs or less should be visually inspected by the Quarantine Officer for any contaminants. If contaminants are detected or suspected a sample is to be drawn in accordance with ISTA procedures and submitted to a Quarantine approved seed-testing laboratory for analysis. Consignment must be held under quarantine pending results of the analysis. b) Individual lines or lots of seed with a combined weight over 10 kgs (e.g. 22 x 500 gm packets or 3 x 5 kg bags) should be sampled by the Quarantine Officer in accordance with ISTA procedures and the samples submitted to a Quarantine approved seed-testing laboratory for analysis. Consignment must be held under quarantine pending results of the analysis. Note: There are exceptions to this rule. In the case of large seeds (i.e. seeds greater than 8 mm in size e.g. bean seed, pea seed, pumpkin seed, watermelon seed), Quarantine Officers should draw samples and visually inspect them for contaminants. Samples need only be drawn and submitted to a Quarantine approved seed-testing laboratory if contaminants are detected or suspected. Consignment must be held under quarantine pending results of the analysis. 16. If live insects are found on inspection, the insects must be identified immediately by an AQIS entomologist and the consignment appropriately treated at the importers expense. 17. a) Correctly certified containers (see Point 13) must be forwarded to a Quarantine Approved Premises (Class 1.1 , 1.3 or 2.2) for a full unpack and inspection as per Point 14 and 15. b) In-correctly certified containers (see Point 12) must be forwarded to a Quarantine Approved Premises (Class 1.1 only) for a full unpack and inspection. All consignments are subject to a more intensive inspection of the seed and packaging material for the presence of live insects. 18. Following inspection and provided all of the above conditions have been met the consignment may be released from quarantine. AQIS Standards for Seed Contaminants and Tolerances All seed consignments imported into 1. Soil Seed must be free of soil. Seed contaminated with soil discernible to the naked eye must be cleaned, re-exported or destroyed. Soil is not always readily visible, but 0.1% has been adopted as the standard maximum tolerance. Levels of soil contamination reported on seed analysis certificates are to be rounded to 1 decimal place for assessment purposes. 2. Restricted and Prohibited Seeds Table 1. Restricted Seed Contamination Tolerances (Expressed as the maximum number of contaminant seeds per kilogram)
Karnal Bunt (Tilletia indica) is known to occur in the following
countries: There is a nil tolerance for Triticum spp. and x Triticosecale spp. seed found as a contaminant in consignments of seed exported from the above Karnal bunt affected countries. Consignments found contaminated with Triticum spp. and x Triticosecale spp. must be either re-exported or destroyed. Cleaning is not an option as Karnal bunt spores may be transmitted by the contaminant seed host to other seed in the consignment. Cleaning the seed to remove the contaminant will not remove potential Karnal bunt spores from the consignment. Table 2. Nil Tolerance for Prohibited Seed AQIS defines a prohibited seed as: a) Any species exceeding the tolerance levels for restricted seeds (see Table 1); OR b) Any species listed on ICON as prohibited (including but not limited to those listed in Table 2); OR c) Any species not listed on ICON or Schedule 5 (‘Permitted Seeds List’) of the Quarantine Proclamation 1998; OR d) Any seed that cannot be identified to species level. NOTE: Contaminant seeds not listed on ICON or not identified to species level require an assessment by AQIS Plant Quarantine Programme prior to any action being taken. The following tables are not an exhaustive list of prohibited weed species. Please search the ICON database (ICON Database) to determine whether a particular species is prohibited.
Pelleted Seed 1. All consignments of permissible (i.e. not prohibited by quarantine legislation) flower, vegetable, herb and pasture/forage seeds in pelleted form may be permitted entry provided the pelleted seed was commercially produced and packaged, and the pelleting was carried out using an inert material only. 2. If ICON conditions specify that the seed species being imported requires
additional treatment such as seed fungicide, than this treatment must be
performed either PRIOR to or DURING pelleting. The importer must contact AQIS
Plant Programs, 3. In addition to the requirements specified above consignments of pelleted seed are also subject to the following: Pelleted flower seeds All consignments are subject to inspection on arrival. A random sample of up to a maximum of 50 seeds should be drawn from one container/tin/package, from each line or lot of seed in the consignment. The sample should be de-pelleted and visually inspected for freedom from contaminants. If contaminants are detected or suspected, the consignment should be sampled in accordance with ISTA procedures and submitted to a Quarantine approved seed testing laboratory for analysis. Consignment must be held under quarantine pending results of the analysis. Pelleted vegetable, herb and pasture/forage seeds a) For consignments with seed analysis certificates: Each consignment should be accompanied by an acceptable seed analysis certificate detailing the particular line/lots from which the seed originated, indicating purity and freedom from contaminants. An ISTA International Orange, Blue certificate, or a seed analysis certificate, issued by a seed testing laboratory that conforms to the requirements outlined below would be acceptable. All seed analysis certificates must: · Be endorsed stating that the sample has been officially drawn in accordance with ISTA rules from an identified seed lot; · Be endorsed stating that sample was analysed in accordance with ISTA rules; · Give the actual weight of the bulk sample and the working sample examined; · Give the botanical name (i.e. genus and species) and the number of each identified species of seed found in the sample (any identified genera or species are to be recorded as such); and · Give the percentage of soil particles found in the sample. A random sample of up to a maximum of 50 seeds should be drawn from one container/tin/package from each consignment. The sample should be de-pelleted and visually inspected for freedom from contaminants. If any contaminants are detected or suspected, a sample is to be drawn in accordance with ISTA rules and submitted to a Quarantine approved seed laboratory for analysis. The consignment must be held under quarantine, pending the results of the analysis. b) For consignments without acceptable seed analysis certificates or no certificates: For individual lines or lots with a combined weight not exceeding 10 kg: A sample(s) must be drawn in accordance with ISTA rules, de-pelleted and visually inspected for freedom from contaminants. If any contaminants are detected or suspected another sample is to be drawn in accordance with ISTA rules and submitted to a Quarantine approved seed laboratory for analysis. The consignment must be held under quarantine, pending the results of the analysis. For individual lines or lots with a combined weight of more than 10 kg: Sample(s) must be drawn in accordance with ISTA rules and submitted to a Quarantine approved seed laboratory for analysis. The consignment must be held under quarantine, pending the results of the analysis. Note to the Quarantine Officer: a) The Quarantine Officer must ensure that any packets that are opened for inspection are opened in such a manner that allows the packets to be re-sealed to prevent any spillage of seed. b) Quarantine Officers must ensure that all packets that have been opened are re-sealed. c) Quarantine Officers must not return any seed that has been de-pelleted to the packets from which they originated. |

Seed ex-New In addition to Condition C7100 (Import conditions for seeds for sowing), the
following requirements/procedures may be applied to consignments ex-New a) Consignments of seed ex-New - The consignment is accompanied by an acceptable* seed analysis
certificate issued by an ISTA accredited seed-testing laboratory in * An acceptable seed analysis certificate conforms to requirements outlined in part (c) below and indicates that the results of the analysis meets AQIS requirements in terms of purity and weed seed tolerances. Note: AQIS reserves the right to check/inspect seed accompanied by the above mentioned certificate, at any time. b) Seed analysis certificates are accepted from the following ISTA
accredited seed testing laboratories in
c) The seed analysis certificate must conform with the following requirements: - Be issued by an ISTA accredited seed laboratory; - Be endorsed stating that the sample has been officially drawn and analysed in accordance with ISTA rules from an identified seed lot; - Give the actual weight of the bulk sample and the working sample examined; - Give the botanical name and the number of each identified species of seed found in the sample (any identified genera or species are to be recorded as such); - Give the percentage of soil particles found in the sample; and - Certify that none of the quarantine weed seeds as listed in Table 2. of the ‘AQIS Standards for Seed Contaminants and Tolerances’ were present in the sample. (Refer to ‘Standards for Seed Contaminants and Tolerances‘on the AQIS website). NOTE: AQIS will accept provisional seed analysis certificates pending germination test results if they meet the above requirements. d) Consignments not accompanied by an acceptable seed analysis certificate are to be handled as per the general seed conditions outlined under Condition C7100. Consignments may be subjected to ISTA sampling and analysis. 2. Full Container Loads (FCL) Consignments a) FCL consignments may be handled under the following procedures if accompanied by: - An acceptable seed analysis certificate; and - A Phytosanitary certificate issued by the New Zealand Ministry of Agriculture and Forestry appropriately identified with the consignment and endorsed with “No Live Insects Detected in Examination of Sample”. (This endorsement is to be based on an examination within 14 days prior to shipment.) b) All accompanying certificates are to be presented to AQIS on arrival. c) Certificates are to be carefully examined by the Quarantine Officer to ensure that they are acceptable. d) Where the Quarantine Officer is satisfied that the certificates are acceptable, the following procedures are to apply: For containers containing only one line or lot of seed: Consignments may be either: - Directed for tailgate inspection to verify the line or lot number. The officer must reconcile the bag markings and line or lot number against the certification; or - Forwarded to an AQIS approved premises for unpacking and a verification inspection by a Quarantine Officer. The inspecting officer must physically inspect the consignment to reconcile bag markings and line or lot numbers against the certification. Note: Consignments do not have to be held under quarantine in a specified ‘quarantine area’. However, the imported seed lines should be identified by a prominently displayed notice, “Seed Under Quarantine” or “Seed Subject to Quarantine”. Seed lines should not be block stacked against other seed and a passageway of at least one metre wide should surround imported lines of seed pending clearance. For container containing more than one line or lot of seed - The consignment must be forwarded to an AQIS approved premises for unpacking and a verification inspection by a Quarantine Officer. The inspecting officer must physically inspect the consignment to reconcile bag markings and line or lot numbers against the certification. Note: Consignments do not have to be held under quarantine in a specified ‘quarantine area’. However, the imported seed lines should be identified by a prominently displayed notice “Seed Under Quarantine” or “ Seed Subject to Quarantine”. Seed lines should not be block stacked against other seed and a passageway of at least one metre wide should surround imported lines of seed pending clearance. FCL consignments not accompanied by an acceptable seed analysis certificate will be subject to mandatory sampling and analysis on arrival. e) FCL consignments not accompanied by an acceptable Phytosanitary certificate must be forwarded to an AQIS approved premise for unpacking and inspection by a Quarantine Officer. |

1. Seed Certified by an AQIS Approved Seed Testing Laboratory ( i) Each seed lot must be accompanied by an acceptable* seed analysis certificate from an AQIS approved ISTA accredited seed testing laboratory. * An acceptable seed analysis certificate conforms to requirements outlined in part (iii) below and indicates that the results of the analysis meets AQIS requirements in terms of purity and weed seed tolerances. ii) Seed analysis certificates are accepted from the following ISTA

following seed lot(s): c) Full Container Loads (FCL) Consignments All FCL consignments must meet the certification requirements outlined in point 12 of Condition C7100. Refer to the AQIS publication ‘Cargo Containers: Quarantine aspects and procedures’ Quarantine Procedures 1. All documentation must be presented to a Quarantine Officer for examination on arrival. 2. Each seed analysis certificate must be assessed by a Quarantine Officer to ensure it meets AQIS requirements in terms of purity and weed seed tolerances. - A contaminant species listed as prohibited on ICON or exceeding the
tolerance - Contaminants not listed on ICON or not identified to species level require
an assessment by AQIS Plant Quarantine Programme. 5. AQIS reserves the right, at any time, to conduct verification audits of consignments accompanied by ISTA certificates by drawing ISTA samples and submitting them to a Quarantine Approved ISTA accredited seed-testing laboratory for analysis. 6. Full Container Loads (FCL) Consignments In addition to the above, the following requirements also apply to FCL consignments. a) Correctly certified containers (see point 12 of Condition C7100) may be forwarded to a Quarantine Approved Premises (Class 1.1, 1.3 or 2.2) for a full unpack and verification inspection (see point 4 above). b) In-correctly certified containers (see point 12 of Condition C7100) must be forwarded to a Quarantine Approved Premises (Class 1.1 only) for a full unpack and inspection. All consignments are subject to a more intensive inspection of the seed and packaging material for the presence of live insects. 7. Following inspection and provided all of the above conditions have been met the consignment may be released from quarantine. Important Note: All documentation presented to AQIS as part of the import process must meet the requirements of the Minimum Documentary Requirements Policy. 2. Seed ex-USA – Phytosanitary Endorsement Recommended All commercial seed shipments ex-United States of America over 100g, should be accompanied by a federal or state Phytosanitary Certificate endorsed that: "The seeds in the shipment have been inspected and found apparently free from all species of the genus Trogoderma". For International Mail and Airfreight consignments: When a consignment of seed arrives without certification, a more intensive inspection of the seed and packaging material is to be undertaken for the presence of live insects. FCL consignments: FCL consignments of seed without an accompanying phytosanitary certificate must be directed to a Quarantine Approved Premises (Class 1.1) for a full unpack and inspection. All consignments are subject to a more intensive inspection of the seed and packaging material for the presence of live insects. Note: Fumigation of non-certified seed should only be undertaken after careful consideration of the quarantine risks involved and the effect of the fumigant on the viability of the seed. Where appropriate, consultation should be made with an AQIS entomologist. |

Methyl bromide The Methyl Bromide rate required is 48g/m³ for 2½ hours at 21ºC and above at Normal Atmospheric Pressure (NAP).
